  • Capacity of settlor of revocable trust. The capacity required to create, amend, revoke, or add property to a revocable trust -- or direct the actions of the trustee -- is the same as that required to make a will.
  • Revocation or amendment of revocable trust. Unless the terms of the trust provide that the trust is irrevocable, the settlor may revoke or amend the trust.
  • Interpretation of terms of trust. The rules of construction that apply to the interpretation and disposition of property will also apply as appropriate to the interpretation of the terms of a trust and the disposition of trust property.
  • Contesting the validity of a revocable trust. What is the procedure for contesting the validity of a revocable trust?
  • Disposition of trust property. When may the trustee be subject to liability?
  • Creditor’s claims against settlor. What rules apply?
  • Power of attorney. A settlor’s powers with respect to revocation, amendment, or distribution of trust property may be exercised by an agent under a power of attorney only to the extent authorized by the terms of the trust or the power of attorney.
