Social media photos... e-mail... cell-phone records... online brokerage account information... LinkedIn data... electronic medical records... In Tennessee, what happens to digital assets when someone dies or becomes incapacitated? Unless specifically planned for by a proactive attorney, there can be unintended interference with “digital inheritance.”
Why is this important to your clients? Here are just two examples. A mother may want the pictures left by her deceased child on Facebook. A surviving spouse may need to see the online banking and investment accounts set up by the deceased. But without forethought and planning, such access may be hard to secure.
This is a developing area of the law. Last year the Tennessee legislature enacted the “Revised Uniform Fiduciary Access to Digital Assets Act,” which grants the personal representative of a decedent the right to access the content of electronic communications sent or received by a decedent, and any other digital assets in which, at death, the decedent had a right or interest. The act also permits a fiduciary of a user to ask the custodian to terminate the user’s account.
