Affordable Care Act: Impact on Damages in Tennessee - On-Demand

Audio Conference now available on-demand.

Under the Affordable Care Act (ACA), the vast majority of all injured persons will have at least minimal insurance covering essential health benefits; insurers will not be allowed to drop, deny, or inflate insurance premiums based upon the injury or a pre-existing condition; and injured persons will be entitled to continue their medical treatment without annual or lifetime limits.

Will the fact that individuals are able to seek medical treatment they might not otherwise afford reduce damages? What will be the effect of the ACA on the award of life care expenses?
