Tennessee Advance Medical Directives: How to Better Serve Your Clients' Needs - CD

Substantial improvements in Tennessee's advance medical directive laws were enacted in both 2004 and 2007. The most recent changes conformed the attestation requirements of the Right to Natural Death Act (living wills) to the Health Care Decisions Act (HCDA); added an option for “shifting” authority, analogous to the HCDA; and conformed the attestation requirements of the Durable Power of Attorney for Health Care to the HCDA.

With baby boomers aging and the general population living longer, it is imperative that attorneys be up-to-date on these crucial end-of-life issues.

In addition to statutory changes, the Department of Health periodically updates its Advance Directive Forms, including its Advance Care Plan Form, Appointment of Health Care Agent Form, Appointment of Surrogate Form, and Physician Order for Scope of Treatment Form.

With changes both in the books and in the works, attorneys must be aware of all the complex issues surrounding advance medical directives, as well as related issues dealing with authorizing the treatment of minors and HIPAA privacy restrictions.

You’ll also get up-to-date on advance medical directive forms, including those that have been approved for use by the Department of Health and how to modify standard forms to best suit your clients' needs.
