WEBINAR SNAPSHOT: Learn how to make effective use of judgment enforcement and contempt proceedings in family law cases.

The divorce decree has been entered... but the litigation may not be over. A father fails to pay child support. A mother refuses to turn over the child for visitation with the father. A wife refuses to follow a restraining order that precludes her from coming onto the property of the husband’s business. Or a husband refuses to execute a deed to the wife as required by the divorce decree.

How should you handle these and other situations, and achieve the best possible outcome for your client?

The Court of Appeals recently ruled that contempt is the proper remedy for the breach of a property settlement agreement that has been incorporated into a divorce decree. In another case, the appellate court ruled that the criminal contempt statute expressly limits punishment that a court may award, and it makes no provision for the recovery of attorney fees.
