The Department of Health periodically updates its Advance Directive Forms: Advance Care Plan Form, Appointment of Health Care Agent Form, Appointment of Surrogate Form, and Physician Order for Scope of Treatment (POST) Form.

The legislature has also amended provisions on medical directives. These changes include:

  • Conformed the attestation requirements of the Right to Natural Death Act (living wills) to the Health Care Decisions Act (HCDA);
  • Added an option for "shifting" authority, analogous to the HCDA; and
  • Conformed the attestation requirements of the Durable Power of Attorney for Health Care to the HCDA.
