2011 Alabama Workers' Compensation Law Update - CD

Presented by experienced workers' compensation attorney Bo Kirkpatrick of Carr Allison.

About 23 workers’ compensation opinions are handed down each year by the Supreme Court of Alabama and the Court of Civil Appeals of Alabama. Some of your toughest workers' compensation case management questions can be answered when you join us for this interactive CLE event, all from the comfort of your law office, and hear expert analysis of these decisions:

  • In order to prove that an injury arises out of and in the course of employment under the Workers’ Compensation Act, the employee must show not only that the employment is the source of the accident, but also that it's the cause.
  • Plaintiff, who shuttled cars for defendant, was an independent contractor, not employee.
  • The Salvation Army was immune to employee’s tort claims because the organization was a “special employer” under the three-pronged Terry test.
  • Alabama Workers’ Compensation Act does not give the employer the right to unilaterally withhold payment of an employee’s future medical expenses based on the mere fact that the employe received money in a third-party settlement.
  • A specific purpose doctor cannot make referrals for treatment that falls outside that specific purpose.
  • Venue for an employee’s action against his or her employer is not proper in the county in which the employee resides if the employer does no business by agent in that county and the employer’s principal place of business and production facilities are located in other counties.

The impact of these decisions can affect your clients and strategy dramatically. This 90-minute teleconference is the perfect opportunity to learn how, all while gaining valuable CLE credit. You'll learn about the latest Alabama decisions on:
